This indenture witnesseth that the grantor Thomas W. Huston
and Mary A. Huston, his wife of this Village of Orion in the County of Henry and the State of
Illinois; Omer T. Huston and Elizabeth Barbara Huston, his wife, of the County of Greene, in the
State of Missouri: Luther T. Huston (widower) of the County of Chautauqua in the State of Kansas:
George T. Huston and Laura Huston, his wife of the County of Elk in the State of Kansas: Polly
Hornum and William Hornum, her husband, of the County of Otoe in the State of Nebraska: Rachael
Lewis and Elliott Lewis , her husband, of the County of Keokuk in the State of Iowa: William
Wallace (widower), John W. Wallace, (single), George W. Wallace (single), and Ann E. Wallace,
(single), of the County of Cass in the State of Missouri: and Mary E. Chalmers and Andrew T.
Chalmers, her husband, of the County of Henry on the State of Missouri. Heirs at law of Elizabeth
Huston, deceased, late of the County of Henry in the State of Illinois, for the consideration of
One Dollar, CONVEY and QUIT-CLAIM to John Huston of the Town of Western in the County of Henry and
the State of Illinois, all interest in the following described real estate, to-wit: The West Half
(1/2) of the North East Quarter (1/4) of Section Twenty (20), and the North Third (1/3) of the West
Half (1/2) of the South East Quarter (1/4) of said Section Twenty (20) in Township Sixteen (16)
North of Range One (1) East of the Fourth (4th) Principal Meridian, situated in the
County of Henry in the State of Illinois. Hereby releasing all rights under and by virtue of the
Homestead Exemption Laws of this State, and hereby waiving the same. Whereas the said Elizabeth
Huston, deceased, was in her lifetime seized and possessed of the above described lands and by her
warranty deed dated January 8th - A.D. 1862 attempted to convey the North Half
thereof to the said George T. Huston, and by her warranty Deed of the date attempted to convey the
South Half thereof to the said John Huston, but failed to vest perfect title by the reason of the
description of the premises therein being insufficient, defective and erroneous, and by reason of
said Deeds not showing that at the date of their execution to-wit: Jany 8th, 1862, the said
Elizabeth Huston, grantor therein, was a widow, such being the case, And whereas the said George T.
Huston, afterward, to-wit on January 5th-A.D. 1867 by his warranty deed conveyed to the
said John Huston the lands conveyed to him as above but failed to show by his said deed that he was
an unmarried man, And whereas the said Elizabeth Huston decease many years since, and the said John
Huston, Thomas W. Huston, Omer T. Huston, Luther T. Huston, George T. Huston, Polly Hornum and
Rachel Lewis are the only sons and daughters of the said decadent surviving, and Mary E. Chalmers
is the only heir at law of her mother, a deceased daughter of the said decedent, and the said
William Wallace is the surviving husband, and the said John N. Wallace, George W. Wallace, and
Annie E. Wallace, and also, __________________ Wallace and
_______________ Wallace, minors, are the only heirs at law of Charlotte Wallace
deceased who was a daughter of the said Elizabeth Huston deceased. And there are no other
descendants of any deceased child or children of said Elizabeth Huston, deceased. And whereas said
John Huston has had peaceable possession of, and paid all taxes on said lands since and in part,
before the date of said deeds and made valuable improvements thereof. Now, therefore, this deed is
given to carry out the intention of the Grantor in the said deeds: and that justice may be done.
And that a perfect title of record (except as to said minors) be vested in said John Huston without
the expense and delay of litigation.
